"For the purpose of these Terms and Conditions, the following definitions shall apply:

1.1 'Device' refers to any computing device including but not limited to desktop computers, laptops, tablets, and smartphones.

1.2 'Technical Suitability' means the compatibility of the Device with the services provided as determined by a technical assessment.

1.3 'Technical Assessment' is the process conducted by us to determine the Technical Suitability of the Devices."

2.1.1 These Terms and Conditions govern the "Accounting Expo Promotion" (hereinafter referred to as "Promotion") offered by Tech4biz Pty Ltd ACN 635 506 688 as Trustee of the Tech4biz No 2 Trust Trading as Harvey Norman Technology for Business (hereinafter referred to as "Promoter").

2.1.2 By participating in the Promotion, participants agree to be bound by these terms and conditions.

2.1.3 The offer is non-transferable and cannot be exchanged for cash or other services.

2.1.4 If the service is cancelled before the end of the 12-month period, any discounts received under this promotion must be repaid to the promoter.

3.1 The Promotion begins at 9:00 AM AEDT on 23 November 2023 and ends at 5:00 PM AEDT on 24 November 2024 (hereinafter referred to as "Promotion Period").

4.1 This promotion is open exclusively to accounting practices that are registered attendees of the Accounting Business Expo Sydney 2023. The promotion is applicable to practices with less than 100 devices only. The Promotion is open to accounting practices who sign up for a 12-month contract with the Promoter for Technology Services and Security within the Promotion Period.

4.2 The Promotion is not open to accounting practices that have more than 100 staff or devices.

4.3 Eligibility for this promotion requires confirmation of attendance at the Accounting Business Expo Sydney 2023, which must be substantiated by a registration confirmation number provided at the time of signing up for this offer. Practices must also verify that they have less than 100 Devices at the time of entering into the agreement.

4.4 The participant must be a registered business entity with an ABN and operate predominantly in Australia.

4.5 Employees of the Promoter, their immediate families, its agencies, affiliates, subsidiaries, or any person professionally connected with the Promotion are not eligible.

5.1 Eligible participants who sign up for a 12-month contract will receive 6 months of their service plan at no charge, the value of which will be determined by the Promoter. To be eligible for 6 months free, the first 6 months are to be paid by monthly payments of which the amount will be outlined in the agreement. Months 7-12 will then be billed at no charge.

5.2 Please note the charges that will be waived include the monthly charges for the packages only. All other charges are specifically excluded, for example but not limited to setup costs, product costs and software licenses.

5.3 Pricing plans start from $99 per user per month ex GST.

6.1 Participation is subject to the technical suitability of the business for Technology Services and Security as determined by the Promoter.

6.2 The Promoter reserves the right to perform technical assessments to ascertain suitability.

6.3 Businesses deemed technically unsuitable for the service by the Promoter, in its sole discretion, are ineligible for the Promotion.

7.1 The Promoter reserves the right to withdraw, amend or terminate the Promotion or these terms and conditions at any time without prior notice.

7.2 The Promoter has the right, in its sole discretion, to disqualify any participant that it judges to be in violation of these terms and conditions.

7.3 The Promoter's decisions regarding all aspects of the Promotion are final and binding.

7.4 We reserve the right to amend or terminate the promotion at any time. However, in the event of any amendment or termination, a notice will be provided to all affected Participants at least 30 days in advance.

8.1 The Promoter shall not be liable for any loss, damage, injury, or any other claim related to the Promotion beyond the provision of the gift vouchers as per these terms and conditions.

8.2 The Promoter is not responsible for any technical failures or other issues that may impede a participant's ability to enter the Promotion.

8.3 Our liability under these Terms and Conditions shall be limited to the value of the 6-month free service offer. This limitation of liability does not exclude liabilities that cannot be excluded under applicable consumer protection laws."

9.1 By entering the Promotion, participants agree to the use of their personal data as per the Promoter’s privacy policy.

9.2 Participants' information will be used only for the purposes of administering this Promotion.

10.1 These Terms are governed by and construed in accordance with the laws of New South Wales, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia. If any provision of these Terms of Use is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of these Terms of Use, which will continue in full force and effect.

11.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

12.1 Any disputes arising from this promotion will first be attempted to be resolved through direct negotiation. Should these efforts fail, we agree to submit to mediation before pursuing any legal action.

14.1 All terms and conditions of this promotion have been designed to be fair and reasonable to both the Participant and the Promoter. If a Participant believes a term is not fair or reasonable, they may contact us to discuss a possible amendment."

1. Notwithstanding any other provision of this Promotion or any other promotion offered by Harvey Norman Technology for Business or any third parties, participants in the “promotion” are not entitled to combine the benefits of this Promotion with any other offer or promotion provided by Harvey Norman Technology for Business, including but not limited to the "Customer Satisfaction Guarantee," or any other promotional offers or discounts that may be available. This Promotion is exclusive and cannot be used in conjunction with any other offer or promotional discount, whether past, present, or future. This clause is to be interpreted in accordance with the laws of New South Wales and is intended to ensure the exclusivity of the Promotion in providing a benefit to the customer, without stacking or amalgamation of promotions or discounts, thus preserving the integrity and the financial sustainability of the promotional offerings provided by Harvey Norman Technology for Business.

(a) Tech4biz Pty Ltd ACN 635 506 688 as trustee of the Tech4biz No 2 Trust (trading as Harvey Norman Technology for Business) provides the Services is an independent franchisee that has been granted a franchise and carries on a Franchisee Business that includes the provision and sale of information technology products and services.

(b) Each Franchisee that operates its Franchisee Business under any name or style of any of the ‘Harvey Norman®’ trade marks is a Franchisee, and unrelated to our Franchisee Business (“Other Harvey Norman Franchisee”); (f) Any and all offers and representations made by us are connected solely to us and our Franchisee Business only; and (g) We do not make, or authorise any offer or representation that is specified or otherwise is made by any Other Harvey Norman Franchisee and do not represent that any goods or services in this Agreement will be offered by or available from any Other Harvey Norman Franchisee at the specified price, or at all and you must not represent otherwise.

This Promotion is in no way sponsored, endorsed, or administered by, or associated with any other entity other than the Promoter.

Participants are reminded that they are subject to the terms and conditions of the 12-month contract for Technology Services and Security, which govern the provision of services and are separate from these Promotion terms and conditions.
